From the Organization Bylaws, Article V, Section 4 — Financial Responsibility:

Upon receiving the findings of the Safety Board, the Board of Directors shall deliberate upon and come to an initial decision regarding the accident or incident, and the Board shall decide the financial responsibility, if any, of the Member or Members involved. In reaching its decision, the Board shall adhere to the following guidelines, measuring them against any mitigating circumstances that may have come to light during the course of the hearing or their deliberations, and in the case of Guest Members, any further restrictions, guidelines and responsibilities the Board may have put in effect prior to the time of the accident or incident:

  • If the event or incident is deemed accidental — i.e., it did not result from pilot error and no violations of Federal Aviation Regulations or The Organization Rules or Procedures occurred — then each Member involved will be required to contribute an amount to defray actual repair or damage costs not to exceed one-third of the current Organization Membership Fee in force as of the date of the event.
  • If the event or incident is determined to have been a result of pilot error, but no violation of The Organization Rules and Procedures or Federal Aviation Regulations has been determined to have occurred, then each Member involved shall be required to contribute an equal share of the actual repair or damage costs up to an amount not to exceed the current Membership Fee to join the Organization.
  • If the accident or incident is determined to have occurred in association with one or more violations of The Organization Rules and Procedures and/or Federal Aviation Regulations, then each Member involved shall be required to contribute an amount not to exceed an equal share of the total actual repair or replacement costs, even if the Organization decides not to repair or replace that aircraft.
  • In the case where a piece of Organization equipment so damaged is covered by hull or other replacement insurance, the Board, at its discretion, shall determine an amount to cover deductible costs, and an additional amount as a fine to cover any anticipated increase in insurance premiums as a result of the event or accident during the next insurance year.
